TERMS AND CONDITIONS OF THE WYSOCKI COFFEE ONLINE STORE

§ 1

GENERAL PROVISIONS

  1. These Terms and Conditions apply directly to agreements concluded through the Online Store available at: https://wysocki.coffee/.
  2. The owner of the Online Store is Mateusz Wysocki, conducting business under the company name "Palarnia Kawy Mateusz Wysocki", ul. Dębowa 4, 08-106 Zbuczyn, NIP: 8212581951, REGON: 147377392.
  3. The Buyer has the right to negotiate the terms of the Agreement with the Seller before placing an Order.

 

§ 2

DEFINITIONS

  1. Terms and Conditions – these Terms and Conditions along with the attachment “Returns and Complaints”;
  2. Seller – Mateusz Wysocki, conducting business under the company name "Palarnia Kawy Mateusz Wysocki", ul. Dębowa 4, 08-106 Zbuczyn, NIP: 8212581951, REGON: 147377392;
  3. Buyer – a natural person, legal entity, or organizational unit granted legal personality by the law, entering into an Agreement with the Seller;
  4. Consumer – a Buyer who is a natural person entering into an Agreement with the Seller that is not directly related to their business or professional activity;
  5. Party/Parties – respectively the Seller or the Buyer (or Consumer), or jointly the Seller and the Buyer (or Consumer);
  6. User – any entity using the Online Store;
  7. Online Store – the online store operated by the Seller at the web address: https://wysocki.coffee/;
  8. Goods – items sold by the Seller through the Online Store;
  9. Agreement – a sales agreement concluded by the Parties at a distance via the Online Store;
  10. Order – an offer to conclude an Agreement submitted by the Buyer via the Online Store;
  11. Account – an individual User panel available after registration and logging into the Online Store, used to conclude Agreements;
  12. Registration – the process of creating an Account by the User in the Online Store;
  13. Information – information about the Goods located next to the Goods' image, serving as a description of the main terms and characteristics of the Goods, allowing the Buyer to become acquainted with their properties;
  14. Cart – a method of storing selected Goods by the Buyer for subsequent purchase;
  15. Services Provided Electronically – functionalities of the IT system enabling the Seller to offer certain technical solutions, such as the possibility of setting up and maintaining an Account in the Online Store and the ability to place Orders through the Order Form available in the Online Store without the simultaneous presence of the Parties (at a distance);
  16. Order Form – a technical system in the Online Store enabling the Buyer to place an Order.

 

§ 3

USE OF THE ONLINE STORE

  1. Through the Online Store, the Seller conducts retail sales while simultaneously providing Services Provided Electronically to the Buyers. Through the Online Store, the Buyer can purchase Goods displayed on the Online Store's website.
  2. To use the Online Store, including placing an Order, the Buyer's device does not need to meet any specific technical conditions. It is sufficient to have:
    • Internet access,
    • a standard operating system,
    • a standard web browser,
    • an active email address.
  3. The Buyer can place Orders for Goods and make purchases via the Online Store after prior Registration or without Registration.
  4. Registration in the Online Store is voluntary and free of charge.
  5. To register in the Online Store, the User should fill out the registration form available on the Online Store’s website, providing true data. After filling out the fields in the registration form, a User Account will be created.
  6. If the User’s data required during the Registration process changes, the User is requested to update it.
  7. The User who has registered is obliged to protect access to their Account, particularly by keeping the password to the Account confidential.
  8. A Buyer placing Orders via the Online Store without prior Registration should follow the prompts displayed on the Online Store’s website when placing an Order through the Order Form.

 

§ 4

INFORMATION ABOUT GOODS AND PRICES IN THE ONLINE STORE

  1. Information about the Goods available on the Online Store's pages constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  2. Specifications, descriptions, and drawings of the Goods posted on the Website are for illustrative purposes only and do not form part of the offer unless explicitly referred to in the offer in writing.
  3. Announcements, advertisements, price lists, and other information posted in the Online Store are considered invitations to conclude an Agreement, not offers. They also do not constitute the Seller’s assurances.
  4. Prices indicated in the Online Store are gross values and are given in Polish zloty.
  5. The prices of Goods indicated on the Online Store's page do not include delivery costs and any additional costs associated with the choice of payment options upon delivery. The Buyer decides during the Order process which delivery method to choose. Delivery costs are specified according to each available delivery method.
  6. The Buyer purchases the Goods and places Orders according to the prices and delivery costs applicable at the time of placing the Order.
  7. The Seller reserves the right to change the prices of Goods, conduct and cancel promotional actions and sales or make changes to them. The above rights do not affect the prices of Goods in Orders placed before the date of the price change, promotional conditions, or sales.

 

§ 5

PLACING AN ORDER

  1. The condition for placing an Order is the acceptance of the Terms and Conditions, which the Buyer should read beforehand.
  2. To place an Order, the Buyer should add the Goods they intend to buy to the Cart. Adding Goods to the Cart is not equivalent to placing an Order. Goods can be freely added to or removed from the Cart.
  3. The Cart allows the Buyer to manage the Goods being ordered and calculate the Order value.
  4. When placing Orders, the Buyer can specify the form of the receipt (receipt or VAT invoice).
  5. After placing a correct Order, the Buyer will see the buyer’s and delivery address details, as well as the Order amount and its realization form. If the Buyer accepts all the chosen elements, to effectively place the Order, they need to select the “confirm purchase” button.
  6. Clicking the button finalizing the Order constitutes a declaration of intent by the Buyer leading to the conclusion of an Agreement with the Seller for the Goods covered by the Order.
  7. The Order placed by the Buyer will be confirmed by an email message. It only confirms the receipt of the Order on the Online Store’s email server.
  8. The Seller reviews the Order for feasibility and correctness. The condition for accepting the Order is the availability of the Goods in the Seller’s warehouse and the absence of errors from the Online Store’s system.
  9. The Seller will inform the Buyer in case of unavailability of all or part of the Goods covered by the Order in the Online Store.
  10. After fulfilling the Order, the Seller will send a confirmation of the Order fulfillment to the Buyer's email address and commence shipping the Order to the Buyer.
  11. The Order is shipped to the Buyer in the manner chosen by the Buyer during the Order placement.
  12. The Seller is entitled to refuse to accept an Order placed by the Buyer for justified reasons, particularly when:
    • The Buyer previously placed an Order that was not picked up without providing reasons and without informing the Seller about withdrawing from the agreement;
    • Circumstances related to the placed Order indicate the possibility of fraud.
  13. The Seller will inform the Buyer by email in case of refusal to accept the Order.
  14. The Order fulfillment time is indicated in the description of the Goods.
  15. If the Order includes more than one Good, the Order fulfillment time is the longest time indicated in the description of the product included in the Order.
  16. If payment is not settled within 3 days from the date of placing the Order, the Seller reserves the right to automatically cancel the Order.
  17. The ordered Goods will be delivered to the address indicated by the Buyer.
  18. The day of performing the Agreement concluded via the Online Store is the day of receipt of the shipment by the Buyer.
  19. In the Order form, the Buyer must provide true personal data. The Buyer is responsible for providing false personal data. The Seller reserves the right to suspend Order fulfillment if the Buyer provided false data or if such data raises reasonable doubts about their correctness. In such a case, the Buyer will be informed by phone or email about the Seller’s doubts. The Buyer has the right to clarify all circumstances related to verifying the accuracy of the provided data. If there is no data allowing the Seller to contact the Buyer, the Seller will provide explanations after the Buyer contacts the Seller.
  20. The Buyer declares that all data provided by them in the Order form is true.
  21. The Seller may contact the Buyer at the provided email address or by phone at the contact number indicated by the Buyer to clarify doubts, confirm the Order placement, or for other matters related to Order fulfillment.

 

§ 6

DELIVERY METHODS AND PAYMENTS

  1. Available delivery methods for the Order are described on the Online Store’s website and presented to the Buyer during the Order placement.
  2. Shipments are handled by:
    • InPost sp. z o.o., ul. Wielicka 28, 30-552 Kraków,
    • Poczta Polska S.A., Central Branch, ul. Rodziny Hiszpańskich 6, 00-940 Warszawa,
    • FedEx Express International B.V., Taurusavenue 111, 2132 LS Hoofddorp, The Netherlands,
    • RUCH S.A., ul. Annopol 17A, 03-236 Warszawa,
    • DPD Polska Spółka z ograniczoną odpowiedzialnością, ul. Mineralna 15, 02-274 Warszawa.
  3. Available payment methods for the Order are described on the Online Store’s website and presented to the Buyer during the Order placement.
  4. Available payment methods:
    • via the online payment system Tpay - payment is handled by Krajowy Integrator Płatności S.A., ul. Święty Marcin 73/6, 61-808 Poznań,
    • cash on delivery with the courier.
  5. The cost of delivery is borne by the Buyer unless the Seller indicates otherwise on the Online Store’s website.
  6. Electronic payments, including card payments, are handled by PayU S.A.
  7. The entity providing online payment processing for quick transfers is Blue Media S.A.
  8. If the payment method chosen is through the electronic payment system, the Buyer will be redirected from the Online Store’s website to the indicated payment system website during the Order placement process.

 

§ 7

PROVISION OF SERVICES ELECTRONICALLY

  1. The Seller provides the following Services Electronically through the Online Store:
    • setting up and maintaining an Account in the Online Store,
    • placing an Order through the appropriate Order Form.
  2. The User’s Account stores their data and the history of Orders placed by them in the Online Store. The User logs into the Account using their email address and a password defined by them.
  3. The provision of electronic services by the Service Provider is free of charge.
  4. The User is obliged to use the Online Store in a lawful manner and in accordance with good practices, respecting the personal rights and intellectual property rights of third parties.
  5. Setting up an Account in the Online Store is done by filling out and submitting the registration form via the Online Store’s automatic mechanism. Upon submitting the registration form, an agreement for maintaining the Account in the Online Store is concluded between the Buyer and the Seller. The agreement is concluded for an indefinite period, and the Buyer can terminate this agreement with immediate effect at any time by deleting the Account.
  6. To ensure the security of the Buyer and data transmission in connection with using the Online Store, the Seller undertakes technical and organizational measures appropriate to the degree of risk to the security of the provided services, in particular measures to prevent unauthorized acquisition and modification of personal data.
  7. The Seller undertakes actions to ensure the proper functioning of the Online Store. The User should inform the Seller about any irregularities or interruptions in the functioning of the Online Store.
  8. Any complaints related to the functioning of the Store can be submitted by the User via email to info@wysocki.coffee. The complaint should include the User’s name, correspondence address, and the type and date of the malfunction related to the functioning of the Online Store. The Seller will review complaints regarding the functioning of the Online Store within 14 days from receiving the complaint and will inform the User about the decision via email to the email address of the complainant.

 

§ 8

PERSONAL DATA AND COOKIES

  1. The Seller is the controller of the Buyer’s personal data.
  2. The Buyer’s personal data is processed to handle the User Account, fulfill Orders, and possibly defend, pursue, or establish claims related to Agreements concluded via the Online Store.
  3. Details regarding the processing of personal data and the use of cookies are found in the Online Store’s privacy policy.

 

§ 9

ALTERNATIVE DISPUTE RESOLUTION METHODS

  1. The Seller agrees to submit any disputes arising from the sale of Goods to mediation. Details will be determined by the conflict parties.
  2. The Consumer has the option of using alternative dispute resolution methods. Among other things, the Consumer can:
    • approach a permanent consumer arbitration court with a request to resolve a dispute arising from the concluded Agreement,
    • request the voivodeship inspector of the Trade Inspection to initiate mediation proceedings for the amicable resolution of a dispute between the Consumer and the Seller,
    • use the assistance of a district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection.

§ 10

FINAL PROVISIONS

  1. The Seller is not responsible for errors in handling the Order or other instructions of the Buyer caused by the Buyer providing incorrect data.
  2. Matters not regulated in the Terms and Conditions are governed by applicable law, particularly the provisions of the Civil Code and the Consumer Rights Act.
  3. The Seller reserves the right to amend the Terms and Conditions. Any changes to the Terms and Conditions come into effect on the date indicated by the Seller. Orders placed before the effective date of the changes to these Terms and Conditions are processed based on the provisions in force on the date of placing the Order.
  4. The Seller is not responsible for disruptions, including interruptions in the functioning of the Online Store caused by force majeure, unlawful actions of third parties, or the incompatibility of the Online Store with the Buyer’s technical infrastructure.
  5. Users can contact the Seller in the following ways:
  6. These Terms and Conditions are effective from June 18, 2024, and replace the previously applicable Terms and Conditions in the Online Store.
  7. Users who have an account in the Online Store will be notified of any changes to the Terms and Conditions by email to the email address assigned to the account. In case of non-acceptance of the new Terms and Conditions, the User has the right to terminate the account maintenance agreement by deleting the account at any time.
  8. The Terms and Conditions are published on the website https://wysocki.coffee/. Any changes to the Terms and Conditions will be made in the same manner.
